Romans Courts Courses
Romans courts were the courts of justice employed by the Roman Empire from the earliest times until late antiquity. They were held under the aegis of the imperial magistrates, similar to modern court systems. These courts formed part of the Roman legal system and served to administer justice and adjudicate criminal and civil cases. Under the Roman Republic, the legal system was organized around criminal courts known as Quaestiones Perpetuae, or permanent inquests. The ultimate authority in these cases lay with the judges and magistrates, though there was a right of appeal. In the later Roman Empire, the emperors assumed control over the legal process and limited the right of capital punishment befitting their absolute power. The administration of justice was done in a public forum and open to observation. In many instances, the accused was required to appear in court and present a defense, though this was not always adhered to. The Roman system of justice was based on the principles of natural law and established rules and regulations, as well as laws and decrees set down by the emperor. Punishments and sentences were carried out as prescribed by law. While the death penalty was not unknown, Roman courts typically favored other forms of retribution, such as exile and fines. In any case, justice was carried out in accordance with the imperial law of the land and could change greatly depending on the era. Roman legal principles and practices influenced Western justice systems, and still exist in a modified form in the legal systems of many countries today.
